Data protection has a high priority at WILAmed GmbH. We are pleased that you have visited our website and would like to use this data protection declaration to inform you in more detail about how WILAmed GmbH handles personal data. §1 Information on the collection of personal data and purpose of processing

(1) In the following, we inform you about the collection of personal data when using our website. The relevant legal provisions can be found in the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). According to Art. 4 No. 1 DSGVO, personal data are all data that can be personally related to you (e.g. name, address, e-mail addresses, user behavior or IP address, i.e. identification of the visitor’s device). The purpose of the processing is in particular the operation of our Internet pages for the purpose of offering medical devices and products in the field of intensive care ventilation, respiratory gas humidification and corresponding hose systems, for the presentation of information about our company, for contacting us, as well as the publication of job advertisements and the receipt of applications.

(2) The person responsible for the processing of personal data on the internet pages of WILAmed GmbH pursuant to Art. 4 (7) EU General Data Protection Regulation (DS-GVO) is:

(3) There are two ways in which personal data can be processed on or via our websites.

On the one hand, automatic processing directly by calling up the Internet pages and, on the other hand, by you granting further consent or using our contact options.

a) Automatic storage, “hosting” and “cookies”

aa) In the case of merely informational use of the website, i.e. if you do not fill out a contact form or otherwise transmit information to us, we only process the personal data that your browser automatically transmits to our server. This is technically necessary to display our website to you and to ensure its stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DS-GVO). In detail, this is the following data:

–   Time zone difference from Greenwich Mean Time (GMT)
–   Content of the request (specific page)
–   Access status/HTTP status code
–   Amount of data transferred in each case

bb) The so-called “hosting”, i.e. the storage of the data accruing in connection with the Internet presence, is carried out by IONOS SE, Eigendorfer Str. 57, 56410 Montabaur. The personal data collected on our Internet pages is stored on the hoster’s servers. The hoster is used for the purpose of fulfilling contracts with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO). Our hoster will only process your data to the extent necessary to fulfill its service obligations and follow our instructions in this regard. The data is stored for a maximum of eight weeks.

cc) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are assigned to the browser you are using and stored on your hard drive and through which the body that sets the cookie (in this case by us) receives certain information. Cookies cannot execute programs or transfer viruses to your computer. The internet pages of WILAmed GmbH only use essential cookies without the consent of the visitors. Essential cookies and services are necessary for the basic functionality of the website. They contain only technically necessary services. These services cannot be objected to.

The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the storage of the cookies in question is based exclusively on this consent (Art. 6 para. 1 lit. a DSGVO); consent can be revoked at any time.

The consent is requested directly when calling up the Internet pages within the framework of a so-called “cookie banner”. With your consent, functional cookies or services are also used. Functional services are necessary to provide features that go beyond the essential functionality of the website, such as improved fonts, video playback or interactive Web 2.0 features. Content from video and social media platforms, for example, is blocked by default and can be consented to. When the service is consented, this content is automatically loaded without further manual consent. b) Contact via our website (contact form and job advertisement/application), by e-mail, telephone or fax

When you contact us by e-mail, telephone, fax or via our contact form, the data you provide will be sent internally to an e-mail address at WILAmed and processed by us in order to deal with your request. We do not pass on this data to third parties without your consent. The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested. The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions – in particular retention periods – remain unaffected. The management of our career pages is handled by Softgarden as an external specialist service provider. If you fill in the relevant forms or use the services offered, you will be taken to the Softgarden website. Softgarden is responsible for its own Internet presence. With regard to the processed data, there is an order processing agreement (AVV) in accordance with data protection law pursuant to Art. 28 DSGVO. (4) We offer you the opportunity to apply to us (e.g. by e-mail, post or via online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

a) If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.), insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG), Article 6 (1) (b) DSGVO and – if you have given your consent – Article 6 (1) (a) DSGVO. The consent can be revoked at any time.

Your personal data will only be passed on within our company to persons who are involved in processing your application. If the application is successful, the data you submitted will be stored in our data processing systems on the basis of Section 26 BDSG-neu and Art. 6 (1) lit. b DSGVO for the purpose of implementing the employment relationship. These systems provide special security and are only accessible to a strictly limited group of persons.

b) If we are unable to make you a job offer, if you reject a job offer, or if you withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6 Para. 1 lit. f DSGVO) for up to 6 months from the end of the application process (rejection or withdrawal of the application). Subsequently, the data will be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will not be deleted until the purpose for continued storage no longer applies.

A longer storage can also take place if you have given a corresponding consent (Art. 6 para. 1 lit. a DSGVO) or if legal storage obligations oppose the deletion.

(5) This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

 §2 Social Media

WILAmed is present in the so-called “social media”. On our internet pages, we want to establish corresponding links and make the respective contents directly accessible to our visitors “from one source”. This is done in two ways, namely on the one hand by directly integrating selected social media into our internet pages and/or on the other hand by providing corresponding “links” that lead the visitor to our contributions on the internet pages of the respective provider.

(1) Integration of social media in our Internet pages

The following offers are directly integrated into our Internet pages:

a) YouTube

Our website uses plug-ins of the Google-operated site YouTube for marketing purposes, so that a connection to the servers of YouTube is established. The operator is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. In the process, the YouTube server is informed of the IP address of visitors to our website as well as which of our pages you have visited, provided you have given us your consent to the collection and transmission of your personal data pursuant to Art. 6 (1) a DSGVO. This happens regardless of whether you have a YouTube user account or not. If you are logged into your YouTube account, you also enable YouTube to assign your browsing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account. Note on data transfer to the USA: If tools from companies based in the USA are integrated and active, your personal data may be transferred to the US servers of the respective companies.

The handling of personal data by US companies and, in particular, their obligation to hand it over to security authorities without you as the data subject being able to take legal action against this is controversial. In the meantime, the EU Commission has certified that the USA provides equivalent data protection. We have no influence on these processing activities.

b) Instagram

We use a feed of the service Instagram on our website. Instagram is a social media platform that allows users to share photos and videos and to redistribute such data on other social networks (“Instagram”). The operating company of the Instagram services for users in the European Economic Area is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. The Instagram feed is integrated into our website via an iFrame and ensures that we can show you our Instagram content (such as photos and videos) on our website. The feed is disabled (grayed out) by default. Only when you click on the “I agree” button does your browser make a request to the Instagram media server, which also transmits your IP address so that the iFrame with our Instagram content can be displayed to you. This is technically necessary for the transmission. The legal basis for this is Art. 6 para. 1 lit. a) DSGVO. Incidentally, our websites contain links to our Instagram account so that you can follow us on Instagram. (2) Linking of social media

The following offers are (additionally) accessible via a linking of the respective external Internet offers on our Internet pages:

When linking to external sites, WILAmed cannot assume any responsibility for the corresponding offers of external providers, as WILAmed has no influence on the contents there. Please inform yourself about the processing of personal data there via the respective data protection declarations.

§3 Your rights as a data subject

(1) You have the following rights against us regarding the personal data concerning you:

–   Right of access (Art. 15 GDPR),
–   Right to rectification or erasure (Art. 16 and 17 DS-GVO),
–   Right to restriction of processing (Art. 18 DS-GVO),
–   Right to object to processing (Art. 21 DS-GVO),
–   Right to data portability (Art. 20 DS-GVO),
–   Right to revoke consent given (Art. 7(3) DS-GVO).

(2) Insofar as we base the processing of your personal data on the balance of interests, you may also object to the processing.

When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the merits of the case and either discontinue or adapt the data processing or show you our compelling legitimate grounds on the basis of which we will continue the processing.

(4) You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us. The competent supervisory authority for WILAmed GmbH is the Bavarian State Office for Data Protection Supervision (BayLDA).

§4 Storage period

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons no longer apply.
